By accessing and using EpochNotes ("the Service"), you accept and agree to be bound by the terms and provision of this agreement.
EpochNotes is an AI-powered transcription and note-taking application that:
Local Storage: Audio recordings are initially stored on your local device.
Processing: Audio files are temporarily forwarded to our backend services and processed using Google's Gemini AI for transcription, summarization, and question-answering.
Data Retention: We do not permanently store your audio recordings, transcriptions, summaries, or Q&A content on our backend services after processing is complete.
Personal Information: We do not collect or store personal information such as email addresses or names, as our service does not require user login.
You agree not to use the Service for:
The EpochNotes application is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the application on any Apple-branded devices that you own or control for personal or commercial use.

Free Tier: We reserve the right to modify usage limits for free tier users at any time without prior notice.
Premium Users: Usage limit changes will take effect on your next billing date. We will notify you of such changes through the app interface.
Premium subscriptions are available on a recurring basis (monthly or annually). All purchases, billing, subscription management, cancellations, and refunds are handled exclusively through Apple's App Store and are subject to Apple's Terms of Sale and their subscription policies.
To manage your subscription, cancel, or request a refund, please visit your Apple ID Account Settings or refer to Apple's subscription management documentation.
Price Changes: We may change subscription prices at any time. Price changes for existing subscribers will take effect at the start of the next subscription period following notice to you.
Support: Apple is not responsible for providing maintenance or support services for the application. Any questions, issues, or support requests regarding the application should be directed to support@codehub.nl.
Your Rights: You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation will take effect at the end of your current billing period.
Our Rights: We reserve the right to suspend or terminate your access to the Service, with or without notice, if you violate these Terms or engage in fraudulent, abusive, or illegal activity. Your license under these Terms will terminate automatically if you fail to comply with any of its terms.
Effect of Termination: Upon termination, you must cease all use of the application and may be required to delete it from your devices. Termination does not entitle you to a refund of any fees already paid.
Data Collection: You agree that we may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you related to the application.

AI Processing: Our Service utilizes Google's Gemini AI for processing. Your use of the Service is also subject to Google's terms and policies regarding their AI services.

We are not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services.
You will not use External Services in any manner that is inconsistent with these Terms or that infringes the intellectual property rights of any third party. External Services may not be available in all languages or regions, and may not be appropriate for use in any particular location. We reserve the right to change, suspend, remove, or disable access to any External Services at any time without notice or liability to you.

We do not guarantee the accuracy of transcriptions, summaries, or any AI-generated content. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US OR OUR AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE SERVICE PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

These Terms and the relationship between you and EpochNotes shall be governed by the laws of the Netherlands, excluding its conflicts of law provisions, except where applicable law requires otherwise.
If you are a citizen of any European Union country, Switzerland, Norway, or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence, and you may have additional consumer rights under local law.
Specifically excluded from application to these Terms is the United Nations Convention on the International Sale of Goods.
Any claims relating to the application or your use of the Service should be directed to support@codehub.nl. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the application distributed through the Apple App Store, and Apple will have the right to enforce these Terms against you as a third-party beneficiary.
In the event of any third-party claim that the application or your possession and use of the application infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim to the extent required by these Terms.
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of the Service constitutes acceptance of modified terms. If you do not agree to the modified terms, you must discontinue use of the Service and cancel your subscription.
